Referral Program Terms & Conditions

These Referral Program Terms & Conditions (“Referral T&Cs”) represent a binding contract between you and LivingLab, Inc. (“Alcove,” “we,” “us,” or “our”). By participating in the homeowner referral program (“Referral Program”) either as a Referrer or as an individual referred (“Referee”) to Alcove’s services (“Services”), you expressly agree to be bound by these terms, which are incorporated in the Alcove Terms of Service.

1. Program Details & Eligibility

These terms and conditions (“Terms and Conditions”) apply to the referral of homeowners and listing of properties on Alcove.

The submission of any referral to Alcove indicates acceptance of our terms and conditions. Alcove reserves the right to amend or terminate these conditions at any time without prior notice.

Acceptance of the Program Terms is required in order for you to be eligible to receive a Reward (“Fees”) for Qualified Referrals.

The Referral Program offers individuals (“Referrers”) the opportunity to receive a Reward (as defined below) when they refer someone (“Referee”) to the Services. To refer an individual to the Services, a Referrer must fill out the web form available at https://roommates.alcoverooms.com/homeowner-referral-program

Subject to the limitations below, and as set forth otherwise in the Referral Program, Referrers are eligible to receive a reward with a value detailed below (the “Reward”). Rewards are only available for Qualified Referrals, which are referrals in which a Redeemer:

(a) who has not previously registered for Alcove as a homeowner or property manager, or otherwise provided their contact information (including email address) for any reason to Alcove before the Referrer filled out the web form;

(c) signs a Lease Agreement stating they agree to list their home to Alcove for a minimum term of twelve months;

(d) does not elect any right to exit Redeemer’s obligation to the full term of the lease without penalty.

Without limiting the foregoing, self-referrals are strictly prohibited. When these criteria are met, Referrers may redeem Reward.

2. Additional Rules

By participating in the Program, you hereby represent and warrant that you have obtained consent from the Referee to send such entity’s contact information to Alcove as part of a referral submission, and you believe in good faith that the Referee is interested in listing and leasing their home on the Alcove platform.

After you submit a complete referral submission, Alcove will contact both the Referrer and Referee confirming our receipt of the submission, unless you deselect the “I give Alcove permission to contact this referral” option in the referral website, in which case you will be expected to handle communications between Alcove and the Referrer.

Referrers may not send, publish, or share any false, misleading, or deceptive communications in connection with participation in the Referral Program. Such actions may violate various federal, state, and/or international laws, including, but not limited to, the regulations and policies promulgated by the Federal Trade Commission.

Referrers may not refer children under the age of 18.

3. Reward Structure

Subject to these Program ToS, each Qualified Referral shall be eligible for the benefits set forth below. Alcove will determine eligibility for Rewards and other benefits hereunder in its sole discretion.

For Referrers: Qualifying Approvals of twelve months or greater are eligible for a Reward of a $500 fee for the month following the Reward being earned.

Referrers are solely responsible for ensuring that their account and contact details are accurate, and Alcove shall not be liable for lost, misdirected, or misused Rewards.

Referrers may receive up to five Rewards through the Referral Program during a calendar year, regardless of the number of referrals made or redeemed. Referrer agrees to comply with any applicable limits on the number and/or frequency with which Referrers submit referrals. Failure to comply with such limits may disqualify Referrers from receiving or redeeming Rewards.

All disputes regarding Fees or any other payment amounts must be communicated in writing either by emailing support@alcoverooms.com. You must communicate a dispute within five (5) business days of receipt of the disputed email invoice, and failure to do so shall act as a waiver of any disputes related to the amounts described therein. Alcove reserves the right to withhold Reward in the event of a bona fide dispute, as determined in Alcove’s sole discretion.

In the event that you are paid more than your entitled Reward, whether as a result of calculation errors, unaccounted-for Deductions, or for any other reason, you shall promptly repay Alcove such overpaid amounts, as determined by Alcove. If you fail to promptly return such overpaid amounts, Alcove may offset any such amounts from future payments to you, and you may be suspended or disqualified from the Referral Program, in Alcove’s sole discretion. The foregoing shall be in addition to all rights and remedies Alcove may seek in equity or at law.

4. Termination and Changes

Alcove may modify, suspend, or terminate the Referral Program or a Referrer’s or Redeemer’s ability to participate in the Referral Program at any time for any reason in its sole discretion. Exceptions may be granted on a case-by-case basis by Alcove in its sole discretion.

Alcove reserves the right to suspend or terminate accounts or remove Rewards obtained through the Referral Program if we notice any activity that we believe is abusive, fraudulent, or in violation of our Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate.

5. Updates to the Referral T&Cs

Alcove can update these Referral T&Cs at any time without prior notice. If we modify these Referral T&Cs, we will post the modification on this website, and the new Referral T&Cs will be effective upon posting. Continued participation in the Referral Program after any modification of these Referral T&Cs shall constitute consent to such modification.

6. Defined Terms

Referral Program means the Alcove Homeowner Referral Program

Redeemer means the person redeeming the Reward

Referee means the person being referred to as a homeowner or property manager that lists and/or leases their property through Alcove

Referrer means the person making the referral

Reward means the compensation owed from Alcove to a Referrer or Referee pursuant to the Referral Program as further described in Section 3

Qualifying Approval shall have the meaning set forth in Section 1
